ARTICLE 1 - PARTIES

ARTICLE 2 - SUBJECT
The subject of this agreement is the purchase of the following items by the BUYER, which they have ordered electronically from the SELLER's website www.silkhometr.com:
The sale and delivery of the product, whose specifications and sales price are stated, are governed by Law No. 4077 on Consumer Protection and Distance Sales.
This involves determining the rights and obligations of the parties in accordance with the provisions of the Regulation on the Principles and Procedures for the Implementation of Contracts.

ARTICLE 4 - GENERAL PROVISIONS
4.1 The BUYER acknowledges that the product in question, its basic characteristics, sales price including all taxes, and payment terms are available on the website www.silkhometr.com.
The method of delivery and the costs thereof to be borne by the BUYER, the delivery timeframe, and the SELLER's full commercial terms and conditions.
The individual acknowledges that they have read and are aware of the preliminary information and pre-information form regarding their title, full address, and contact information, and agrees to all its terms and conditions.
He/she declares that he/she understands and has provided the necessary confirmation electronically.
By confirming this agreement electronically, the BUYER acknowledges that, prior to the conclusion of distance contracts, the Seller is required to provide the Consumer with the necessary information.
The address, basic specifications of the ordered products, the price of the products including taxes, and payment and delivery information must also be accurate and complete.

4.2 The product subject to this contract will be delivered within a legal period of 30 days, depending on the distance of the BUYER's place of residence for each product.
The goods will be delivered to the BUYER or the person/organization at the address indicated, within the timeframe specified in the preliminary information on the website. As shown in Article 3.
If the delivery cost is 1000₺ or more, the shipping fee will be covered by the SELLER; if the cost is less than 1000₺, the shipping cost will be borne by the BUYER.
4.3 If the product subject to this contract is to be delivered to a person/entity other than the BUYER, the BUYER shall not be liable if the recipient refuses delivery.
The SELLER cannot be held responsible.
4.4 The shipping company is not responsible for any problems it may encounter during the delivery of the product to the BUYER.
The SELLER cannot be held responsible for any failure to deliver.
4.5 The SELLER shall deliver the product subject to this contract in sound condition, complete, conforming to the specifications stated in the order, and with any warranty documents and user manuals, if applicable.

4.6 The SELLER may, provided there is a justifiable reason, replace the BUYER with a different product of equal quality and price before the expiration of the performance obligation arising from this contract.

4.7 If it becomes impossible to deliver the ordered product or service, the SELLER shall fulfill its contractual obligations.
If it cannot deliver, it shall inform the consumer of this situation before the expiration of the performance obligation arising from the contract and offer the BUYER a different product of equal quality and price.

4.8 Delivery of the product subject to this contract is conditional upon receipt of a signed copy of this contract by the SELLER and payment of the price in the method preferred by the BUYER.
Payment must be made via the specified payment method. If, for any reason, the product price is not paid or is cancelled in the bank records, the SELLER shall retain the right to purchase the product.

4.9 After delivery of the product, if the buyer's credit card is used fraudulently or unlawfully by unauthorized persons due to no fault of the buyer...
If the bank or financial institution concerned fails to pay the SELLER the product price due to its misuse, the BUYER shall return the product to the seller.
Provided that the product has been received, it is mandatory to send it to the SELLER within 3 days. In this case, the shipping costs are the responsibility of the BUYER.
4.10 The SELLER shall not be liable for any damages or interruptions to the contract due to force majeure or extraordinary circumstances such as adverse weather conditions or disruptions to transportation.
If the SELLER is unable to deliver the product within the specified time, they are obligated to inform the BUYER. In this case, the BUYER requests the cancellation of the order and the termination of the contract.

4.11 For matters not covered in this agreement, the Turkish Commercial Code, the Law on Consumer Protection, and the Distance Contracts Law shall apply.
The provisions of the Regulation on Implementation Procedures and Principles will be applied.
ARTICLE 5 - RIGHT OF WITHDRAWAL
The BUYER has 7 days from the date of delivery of the product subject to the contract to himself or to the person/organization at the address indicated, without giving any reason.
They have the right to withdraw without being obligated to do so.
However, products that are specially prepared, offered for sale and/or imported for the BUYER for specific days such as New Year's Day, Valentine's Day, Mother's Day, etc.
Please note that returns are not accepted for products, campaign or promotional items, and the BUYER acknowledges that they are aware of these conditions and that the purchase is made specifically for them.
You acknowledge that under no circumstances will the prepared product be eligible for return, and you agree not to raise any objections now or in the future.

To exercise the right of withdrawal, the SELLER must be notified by email within 7 days and the product must be returned in accordance with the provisions of Article 6.

The shipping cost for products returned due to the right of withdrawal will be covered by the SELLER.
When returning the product to the SELLER, the original invoice presented to the BUYER at the time of delivery of the product must also be included (for consistency with our accounting records).

ARTICLE 6 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
In distance selling contracts, the consumer has no legal or criminal liability whatsoever within 7 days of the date of delivery.

ARTICLE 7 - DEFAULT BY THE DEBTOR
In the event of the BUYER's default, the BUYER agrees to indemnify the SELLER for all damages and losses incurred due to the delayed performance of the debt.
If the default is due to the SELLER's failure to deliver the goods without cause or notice, or due to the delivery of defective goods, the BUYER

ARTICLE 8 - COMPETENT COURT
In the implementation of this agreement, Consumer Arbitration Boards and Istanbul Courts shall have jurisdiction up to the value declared by the Ministry of Industry and Trade.
